                Younger Marketing Management Ltd provide the following warranties for any SuraFlow system that you purchase from us and which we also install:

1.1

(a)            that the Product will be free from any defects. If the Product develops a defect and you notify us of this defect within a reasonable period of time from the date of completion of the installation, you can choose whether to have it repaired or replaced but if, in our reasonable opinion, the defect is minor we will have the right to repair it rather than replace the Product if we so wish.

 

(b)            that we will carry out the installation of the Product with reasonable skill and care. If we do not carry out the installation with reasonable skill and care and you request us to do so within a reasonable period of time of the date of completion of the installation, we will carry out the relevant part of the installation again but if, in our reasonable opinion, it is more appropriate to repair rather than re-install, we will have the right to carry out the necessary repairs if we so wish.

 

1.2            Each of the warranties set out above are valid for a period of five years commencing on the date that the installation is completed by us.

 

2.             NO CLOG WARRANTY

 

2.1            If you purchase a complete Suraflow-GutterGard rainwater system (the “System”) from us which we also install, we warrant that the System will not become blocked by Debris entering the System:

 

(a)            in the case an aluminium System, for a period of up to thirty years from the date of installation;

 

(b)            in the case of a plastic System, for a period of up to twenty years from the date of installation.

 

2.2            In the event that Debris enters and blocks the System within the time periods referred to in 2.1 above and you notify us of this within a reasonable period of time of the blockage occuring, we shall attend at your property as soon as is practicable to unblock the System.

 

2.3            Your statutory rights are not affected by these warranties.

 

 3.            EXCLUSIONS                           

 

3.1            Explanatory Note       

 

You should be aware that there are a number of factors which can affect the extent to which the Product and its installation (whether as part of a complete rainwater system or alongside other products) will be effective.

 

                In particular, whilst we have done everything we reasonably can do during our visual inspection of your house to identify such factors and to tell you about them, there may be other factors which will affect the successful operation of the Product which we could not reasonably be expected to identify from our visual inspection of your house or during installation. For example, the specifications of your roof design may be incompatible with the installation of the Product or your house may have inadequate or blocked soakaways.

 

                Further, the effectiveness of the Product will be adversely affected by, for example, someone else damaging it whilst repairing the roofline of your house or extreme weather conditions such as unusually heavy snowfall or very strong gale force winds. These factors are not related to the quality of the Product or the skill and care with which we undertake the installation. In the event that you are aware of any such factors please tell us about them immediately so we can advise you whether they will adversely affect the operation of the Product and/or if you need to seek further specialist advice.

 

3.2            We shall have no liablity to you for a breach of the warranties set out 1.1 above in the event that any defect or problem with an installation is caused by:

 

(a)            someone other than ourselves, for example, accidental damage or vandalism or exposure to excessive heat such as barbeques; and/or

 

(b)            extreme weather, for example, heavy snow fall or very strong gale force winds, lightning, hurricane or other acts of God; and/or

 

(c)            the existence or development of a factor in connection with the relevant property, which we are not aware of and which we could not reasonably be expected to identify on the date of our visual inspection of the relevant property or during installation, which makes it impossible for the System to operate effectively, for example faulty roof design, blocked soakaways or structural shrinkage; and/or

 

(d)            exposure to the elements, air pollution or to chemicals, for example, changes in surface colour of the Product may occur over time as a result of exposure to the elements.

 

3.3            Your statutory rights are not affected by these exclusions.

 

4.             Assignment

 

In the event that you sell the property on which we have installed the System, you may assign the benefit of the warranties set out at 1.1 above to the purchaser if you tell us the name of the purchaser and on satisfaction of the following conditions:

 

(i)                    receipt by you of our consent to such assignment in writing; and

 

(ii)                payment to us of our nominal administration fee.
